Usually not in the first message. Naming a law you have half-remembered gives the other side something to correct instead of something to fix. State the facts and the request; keep the legal argument in reserve for a second message if the first is refused.

Short. Four short paragraphs is plenty: what you bought, what went wrong, what you want, how to reach you. Long emails get skimmed and skimming loses your details.
